I’m not a birther, not by a long shot. As a matter of fact, I think most birthers are simply off their rocker. However, I’m also a strong supporter of our Constitution and believe that it is, truly, the supreme law of the land. As such, NO ONE has the right to disregard it – especially the very people responsible for supporting and defending it.
While I contend that President Obama has already proven his citizenship, I am not averse to forcing EVERY candidate to undergo a public constitutional litmus test prior to being allowed on a ballot regulated by our founding documents. Once each party has selected a candidate for a particular office, the following certifications must be performed publicly by the Supreme Court to ensure their qualifications for office:
President: proof of age in the form of an original or certified copy of birth certificate. The birth certificate would prove the candidate is no less than 30 years old. Proof of residency within the United State for the previous 14 years. This proof could be provided with tax returns or some other official documentation. In the event the president cannot perform his duties, the Vice President must go through the same certification prior to taking office. If unable to provide proof or certification, each successive individual must go through the public process.
Senators: proof of age in the form of an original or certified copy of birth certificate. The birth certificate would prove the candidate is no less than 35 years old. Proof of residency within the United State for the previous nine years. This proof could be provided with tax returns or some other official documentation. The Vice President, as president of the Senate, must go through this process as well. They must also prove to be an inhabitant in their respective state at the time of selection.
Representatives: proof of citizenship in the form of an original or certified copy of birth certificate. The birth certificate would prove citizenship and age (no less than 25 years old). Proof of residency within the United State for the previous seven years. This proof could be provided with tax returns or some other official documentation. They must also prove to be an inhabitant in their respective state at the time of selection.
Long intro, but Texas is doing that. Texas Representative Leo Berman has introduced House Bill 529 relating to certification for placement on the ballot of candidates for president or vice-president of the United States.
(d)The secretary of state may not certify the name of a candidate for president or vice-president unless the candidate has presented:
(1)the candidate ’s original birth certificate indicating the name of the hospital and the physician of record; or
(2)for a candidate whose birth was not documented in the manner required by Subdivision (1), a document certifying the candidate ’s birth in the United States.
In order to be placed on any Texas ballot, each candidate MUST meet these qualifications. Granted, this legislation is probably a result of the birther movement, but I wholly support this bill and believe this should occur REGARDLESS of the manufactured controversy surrounding this president. We have a constitution for a reason. We should abide by it whether the candidate is white, black, red, or blue.

The Constitution is now Tea Party BS?! Damn, I need to get my membership dues submitted. Since when is adhering to the constitutional requirements “trivial nonsense?” Why even have a constitution if we’re not going to use it? Let’s just live in anarchy.

Since when do Senators and members of the House of Representatives need to be born in the United States? They only have to be citizens, that is why Arnold Schwarzegger could run for the Senate but not for President, because he is a citizen but not born in America. I think you need to change your requirements for Senator and Representatives to reflect this. From the constitution website:
“No Person shall be a Representative who shall not have attained to the Age of twenty five Years, and been seven Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State in which he shall be chosen.” Nothing about being born in America.

Wow Scott, have you ever read the requirements to be President? Only the President and VP have to be Natural Born Citizens! That IS in the Constitution!
Frankly, it will be up to the USSC to determine what NBC means. I personally believe that it means Citizen Parents. NBC is mentioned only in the requirement for the Pres. and VP. therefore it must have significant meaning. They even exempted themselves from the requirement since they themselves were not NBC. At the time the Constitution was written, the only reference to the phrase is explained in de Vattel’s law of Nations, NOT Blackstone! While some of our laws are based on English Common law, we have many that are not due to the fact that we are citizens, not subjects.

This article has the wrong number for the bill, well the right numbers in the wrong order. The bill filed by Leo Berman, is Texas House Bill 295, not 529. So, to you Texas legislators, don’t even give 529 a thought, until you’ve passed 295.

Are any Senators , congressmen or any one fingerprinted before getting the job?
Do they have to show any proof of identity?
proof of age?
To get a Civil Service job I had to show my birth certificate, my driver’s license, Be fingerprinted and undergo a full background check
Does anyone know what our legislators are required to do ?

They should be required according to the constitution, just as the President should be!
